		<Abstract>The issue of a party’s refusal to fulfill its contractual obligations is one of the most challenging legal problems, and the guarantees arising from such refusal play a crucial role in preventing breaches. This study, conducted using a descriptive-analytical method, seeks to examine the views of jurists from the five major denominations of thought regarding a party’s failure to meet its contractual duties. The findings indicate that, while Imamiyyah jurists acknowledge the necessity of guarantees in the event of a contract breach, they refrain from extending the no-harm principle (Qā’idat lā ḍarar) to financial guarantees, considering contractual commitments to be tied to the principles of loss (Ḍamān) and causality (Sababiyyah). This implies that individuals are liable for harm caused by their actions when they undertake a specific duty, regardless of their supervisory role. Both Imamiyyah and Sunni jurists argue that contractual and obligatory guarantees rest on the same foundation, emphasizing that the existence of a contractual relationship does not alter their nature. Apart from the Ḥanafī denomination, most Sunni denominations of law do not confine the no-harm principle to physical property; they also regard lost benefits as a basis for guarantees. To seek compensation for such breaches, one must rely on the concepts of loss and causality, as underscored by the jurisprudential maxim, “The blood of a Muslim is not wasted”. Jurists in Islamic countries have also recognized the notion of guarantees arising from the failure to meet contractual obligations as a deterrent against contract violations. They contend that, while contractual commitments depend on the parties’ intentions, compulsory guarantees are prescribed by law and subject to the authority of the legislator.</Abstract>
			<OtherAbstract Language="FA">یکی از موضوعات چالشی در امور حقوقی، استنکاف متعهد از انجام تعهدات قرارداد است که ضمان ناشی از آن، نقش به‌سزایی در جلوگیری از تخلف از انجام تعهدات ایفاء می‌کند. هدف از پژوهش حاضر که با روش توصیفی ـ تحلیلی صورت گرفته، بررسی نظرات فقیهان و حقوقدانان مذاهب خمسه راجع به استنکاف متعهد از انجام تعهدات خویش است. یافته‌های تحقیق نشان داد فقیهان امامیه ضمن پذیرش ضمان طرفهای قرارداد در صورت تخلف، با اجرای قاعده لاضرر در ضمان مالی مخالفند و ضمان متعهد قراردادی را مصداقی از قواعد اتلاف، تسبیب یا علی الید می‌دانند. بدین معنا که وقتی شخصی اجرای کار معینی را بر عهده می‌گیرد ضامن خسارات ناشی از عمل خویش است، هرچند خود مباشر در کار نباشد. فقهای اهل‌سنت نیز همانند امامیه بر این باورند که ضمان قراردادی و قهری دارای مبنای واحدی است و وجود رابطه قراردادی نمی‌تواند ماهیت آن را تغییر دهد. تمام مکاتب فقهی اهل‌سنت، به استثنای فقه حنفی، به استناد قاعده فقهی «لا یحلُّ دَم امرءٍ مُسلم»، رفع ضرر را محدود به عین اموال ندانسته و ضررهایی که شامل منافع نیز می‌شوند را موجب ضمان می‌دانند و برای مطالبه خسارات ناشی از آن باید به قواعد اتلاف و تسبیب متوسل شد. حقوقدانان کشورهای اسلامی هم، ضمان ناشی از تخلف از انجام تعهدات قراردادی را به عنوان یک اصل و اهرم بازدارنده در وقوع تخلفات قراردادی پذیرفته‌اند و معتقدند ضمان قراردادی بر مبنای اراده طرفین است، ولی ضمان قهری بر مبنای قانون و تابعی از حکم قانونگذار است.</OtherAbstract>

		<Abstract>The right of preemption (Shuf‘ah) constitutes an exception to the ordinary rules of sale, as it contravenes the principle of acquisition and transfer of ownership. Consequently, its application is impermissible except in cases explicitly stipulated by the Lawgiver (Shāri‘). Given that, according to the majority of jurists from both Sunni and Shia denominations, if the transfer of property to a third party by one of the two co-owners occurs through means other than sale—namely, through compromise (Ṣulḥ), gift (Hibah), or dower (Ṣidāq) —the other co-owner does not acquire the right of preemption. This raises the question: if the transfer of property takes the form of a sale but is of a benevolent (Iḥsānī) contractual nature, can the right of preemption be exercised? Considering the conditions for the establishment of the right of preemption, as well as its underlying rationale (Manāṭ)—namely, the prevention of harm and detriment to the co-owner—the initial impression suggests that the right of preemption may apply to benevolent contracts. However, through a deeper jurisprudential analysis of the nature of benevolent contracts and with due regard to the rationale underlying the exceptions to the right of preemption, the entitlement of the other co-owner to preemption appears unlikely. This is because the seller’s intention in concluding such a contract is solely to confer a benefit upon the counterparty, and the identity of the counterparty constitutes the primary cause of the contract. In such circumstances, the nature of a benevolent contract resembles that of a gift (Hibah) or compromise (Ṣulḥ), rendering the application of the right of preemption in benevolent contracts impossible. The Civil Code of the Islamic Republic of Iran briefly refers to the conditions of preemption in its definition of the right, without explicitly enumerating its exceptions. In contrast, the Civil Code of Afghanistan expressly addresses the exceptions to preemption by referring to non-negotiated sales (Bay‘ ghayr-mughābanah) and enumerating cases of compromise (Ṣulḥ), charity (Ṣadaqah), gift (Hibah), and dower (Ṣidāq).</Abstract>
			<OtherAbstract Language="FA">حق شفعه یک استثناء در رویه‌های عادی بیع به حساب می‌آید که بر خلاف اصل تملیک و تملک است و لذا جریان آن در غیر از مواردی که از طرف شارع بیان شده، جایز نیست. با توجه به اینکه به‌زعم جمهور فقهای فریقین اگر انتقال مال به شخص ثالث از طرف یکی از دو شریک به غیر از طریق بیع، یعنی به‌صورت صلح یا هبه یا صداق باشد شریک دیگر استحقاق استفاده از شفعه پیدا نمی‌کند این پرسش مطرح می‌شود که اگر انتقال مال به‌صورت بیع ولی از نوع عقد احسانی باشد، آیا حق شفعه می‌تواند جاری شود یا خیر؟ با در نظر گرفتن شرایط ایجاد حق شفعه و هم‌چنین با نظر به مناط حق شفعه که ارتفاع ضرر و اضرار در حق شریک است در نگاه نخستین زمینه جاری شدن حق شفعه در عقد احسانی وجود دارد، اما با نگاه ژرف اجتهادی در ماهیت عقود احسانی و با امعان نظر به مناط مستثنیات حق شفعه، استحقاق حق شفعه برای شریک دیگر بعید به‌نظر می‌رسد؛ زیرا بایع قصدش از انجام عقد تنها نیکی رساندن به طرف مقابل است و شخصیت طرف معامله علت اصلی عقد بوده که در چنین حالتی ماهیت عقد احسانی شبیه هبه و از قبیل صلح است و لذا جریان حق شفعه در عقود احسانی غیرممکن می‌گردد. در قانون مدنی جمهوری اسلامی در تعریف حق شفعه مختصراً اشاره به شروط شفعه شده و اما مستثنیات شفعه به‌صراحت بیان نشده و در مقابل، قانون مدنی افغانستان در موضوع مستثنیات شفعه به بیع غیرمغابنه‌ای اشاره کرده و موارد صلح، صدقه، هبه و صداق نام برده شده است.</OtherAbstract>

		<Abstract>The option contract, or options trading contract, is one of the derivative instruments of the stock exchange in modern international transactions, currently prevalent in domestic and international commercial relations. This type of contract is considered among the newly emergent contracts (al-‘Uqūd al-Mustaḥdathah) which appears to have no precedent in conventional and designated Islamic transactions. Therefore, Islamic scholars, both Shia and Sunni, have sought to examine the jurisprudential validity or invalidity of this contract. The research question of the present study is: what is the jurisprudential ruling on this type of contract according to the Imamiyyah and Sunni denominations, and if it is deemed invalid, can an alternative be found in Islamic jurisprudence and can it be rectified? To this end, using a descriptive-analytical method and library-based tools, the jurisprudential sources of the Imamiyyah and Sunni denominations, as well as existing books and articles on this subject, were consulted and the issue was examined and explored. The findings indicate that among Imamiyyah jurists who have addressed this topic, the majority have generally ruled in favor of the validity of such transactions, citing independent transactions coupled with the right of option (Khiyār), insurance contracts, and ‘Urbūn (earnest money) sale as means of validation and substitution. In contrast, Sunni scholars generally hold this type of contract to be invalid, fundamentally considering it as gambling (Qimār) and a sale involving uncertainty (Bay‘ Ghararī), and thus do not consider any alternative for its rectification. However, those who permit it, like the Imamiyyah scholars, mention ‘Urbūn sale, sale with conditional option (Bay‘ Khiyār al-Sharṭ), commercial insurance contracts, guarantee (Ḍamān) and surety (Kafālah) contracts, and the like as alternatives, while some also independently propose rectification solutions.</Abstract>
			<OtherAbstract Language="FA">قرارداد حق اختیار یا اختیار معامله، یکی از ابزارهای مشتقه بورس در معاملات نوین بین‌المللی است که اکنون در روابط تجاری داخلی و بین‌المللی جاری است. این نوع قرارداد از قراردادهای مستحدثه محسوب می‌شود که به نظر می‌رسد در معاملات معهود و مسمای اسلامی سابقه‌ای ندارد؛ بنابراین اندیشمندان اسلامی در میان شیعه و اهل‌سنت درصدد بررسی فقهی صحت یا بطلان این قرارداد برآمده‌اند. سؤال پژوهش حاضر این است که حکم فقهی این نوع از قرارداد نزد امامیه و اهل‌سنت چیست و در صورت قول به بطلان، آیا جایگزینی برای آن در فقه اسلامی می‌توان یافت و قابل تصحیح است یا خیر؟ به این منظور با روش توصیفی ـ تحلیلی و با ابزار کتابخانه‌ای به منابع فقهی امامیه و اهل‌سنت و کتب و مقالات موجود در این زمینه مراجعه شد و این مسئله بررسی و کاوش گردید. حاصل آنکه در میان فقهای امامیه، کسانی که به این مبحث ورود کرده‌اند، عموماً به صحت این معاملات حکم‏ نموده‌اند و برای تصحیح و جایگزینی، از معامله مستقل همراه با حق خیار، قرارداد بیمه و بیع عربون نام برده‌اند. در مقابل، اهل‌سنت عموماً قائل به بطلان این نوع قرارداد هستند و اساساً آن را قمار و بیع غرری محسوب کرده و بدیلی برای تصحیح آن در نظر نمی‌گیرند. اما قائلان به جواز، همچون علمای امامیه، از بیع عربون، بیع خیار شرط، قرارداد بیمه تجاری، قرارداد ضمانت و کفالت و مانند آنها به‌عنوان جایگزین اسم می‌برند و البته برخی راهکارهای تصحیح را نیز به‌صورت مستقل ذکر می‌کنند.</OtherAbstract>

		<Abstract>Shia and Sunni jurists, as well as some contemporary researchers, have provided various definitions for the term Gharar mentioned in the well-known prophetic tradition prohibiting sales involving Gharar (al-Bay‘ al-Ghararī). In addition to the fact that some of these definitions do not align with the lexical meaning of the term, the divergence among definitions is such that the application of the concept of Gharar to its instances lacks a consistent rule; a given case may be considered an instance of Gharar under one definition while not being so under another. Employing a library-based research method, this study first categorizes the findings related to the definition of Gharar according to the views of different jurisprudential denominations. It then establishes that all definitions are founded upon one or more of four core concepts: ignorance (Jahl), risk (Khaṭar), incapacity to deliver (‘Adam al-Qudrah ‘Alā al-Taslīm), and deception (Khid‘ah). Finally, using a descriptive-analytical method and examining the findings, the study concludes that no single meaning of Gharar can be derived from jurisprudential works and existing research that is capable of encompassing all instances to which Gharar has been attributed. Therefore, through an examination of the relevant traditions and reliance on the lexical meaning, the author contends that among the proposed meanings, risk (Khaṭar) is the most accurate, given its alignment with lexicographers’ views, the absence of a specific technical (Shar‘ī) meaning assigned to the term, and its applicability to the instances mentioned in the traditions. However, this meaning restricts the invocation of Gharar as grounds for contract invalidity to ignorance that entails risk, rather than absolute ignorance.</Abstract>
			<OtherAbstract Language="FA">فقهای شیعه و اهل‌سنت و برخی پژوهشگران معاصر از واژه غرر مذکور در روایت مشهور نهی پیامبر اکرم از بیع غرری، تعاریف متفاوتی ارائه نموده‌ا‌ند که علاوه بر اینکه برخی تعاریف موافق معنای لغوی این واژه نیست، اختلاف در تعاریف به‌گونه‌ای است که تطبیق عنوان غرر بر مصادیقش قاعده‌مند نیست و مواردی بر اساس یک تعریف مصداق غرر است، در حالی ‌که بر اساس تعریف دیگر غرر نیست. این پژوهش با مطالعه کتابخانه‌ای، ابتدا یافته‌های مربوط به تعریف غرر را بر اساس نظر مذاهب فقهی دسته‌بندی نموده و سپس مشخص گردانیده که تمام تعاریف بر یک یا چند مفهوم از مفاهیم چهارگانه جهل، خطر، عدم قدرت بر تسلیم و خدعه استوار گردیده است. در پایان به روش توصیفی ـ تحلیلی با بررسی یافته‌ها به این نتیجه رسیده است که از آثار فقهی و پژوهشهای انجام‌شده نمی‌توان معنایی برای غرر به دست آورد که قابلیت تطبیق بر تمام مصادیق گفته‌شده برای غرر را داشته باشد. لذا با بررسی روایات و تکیه بر معنای لغوی، به نظر نگارنده از بین معانی ذکرشده، معنای خطر به دلیل موافق بودن با قول لغویان و عدم وضع شرعی برای معنای خاص و نیز قابلیت تطبیق بر مصادیق ذکرشده در روایات، صحیح‌ترین معناست. هرچند این معنا استدلال به غرر در بطلان عقد را محدود به جهلی می‌کند که سبب خطر است، نه مطلق جهل.</OtherAbstract>

		<Abstract>One of the financial obligations of a husband towards his wife is the payment of maintenance (Nafaqah). Some jurists have limited the scope of maintenance, while others have considered the wife’s needs as the criterion for its payment. However, some believe that the husband is not responsible for covering the medical expenses of his wife’s incurable diseases. This research, employing an exploratory-analytical method and drawing upon documentary sources, seeks to identify and analyze the jurisprudential ruling on the husband’s responsibility for the medical expenses of his wife’s severe illnesses. To achieve this goal, the first step involves presenting and critiquing the arguments and potential views of those who hold the opinion of non-obligation. In the subsequent step, the body of Islamic teachings concerning women’s rights is examined, with an emphasis on Islam’s focus on strengthening the family institution. The research hypothesis is that the payment of the aforementioned expenses is obligatory for the husband due to the following reasons: the general evidence of good companionship (Mu’āsharat Bil-Ma’rūf) and male guardianship (Qiwāmah), evidence prohibiting the imposition of hardship on the wife, the implications of the man’s responsibility towards his family, narrations indicating non-exclusivity, the argument of priority (Qiyās al-Awlawī), and the practice of the religiously observant (Sīrat al-Mutasharri’ah). The essence of these points is based on presenting a new conception of maintenance in accordance with the wife’s actual needs and the husband’s financial capacity.</Abstract>
			<OtherAbstract Language="FA">یکی از وظایف مالی شوهر نسبت به زوجه، پرداخت نفقه است. فقیهانی، شمار نفقات را محدود دانسته و فقیهانی دیگر ضابطه پرداخت آن را نیازهای زوجه دانسته‌اند. با این وجود، برخی بر این باورند که پرداخت هزینه درمان بیماریهای صعب‌العلاج زوجه بر عهده شوهر نیست. این پژوهش به روش اکتشافی ـ تحلیلی و با بهره‌گیری از منابع اسنادی در پی یافتن و تحلیل حکم فقهی مسئولیت شوهر در برابر هزینه‌ درمانی بیماریهای سخت زوجه است. برای دست یافتن به این هدف، در گام نخست، ادله ادعایی دیدگاه باورمندان به عدم وجوب، تقریر و نقد شده است. در گام بعدی، مجموعه آموزه‌های اسلامی پیرامون حقوق زن با رویکرد تأکید اسلام به تحکیم نهاد خانواده بررسی شده است. فرضیه پژوهش آن است که به دلایل ذیل پرداخت هزینه‌های پیش‌گفته به نحو الزامی بر عهده شوهر است: عموم ادله معاشرت به معروف و قوامیت مرد، ادله نهی از سختگیری بر زوجه، اقتضای مسئولیت مرد در برابر عائله، روایات بیانگر عدم انحصار، قیاس اولویت و سیره متشرعه. جان‌مایه این موارد بر ارائه مفهومی نوین از نفقه بر اساس نیازهای واقعی زوجه و توان شوهر استوار هستند.</OtherAbstract>

		<Abstract>Jurists of Islamic denominations hold divergent views regarding the prescriptive ruling (Ḥukm Taklīfī) on violating a contractual oath (Ḥinth al-Yamīn al-‘Aqdī). Although there is a general consensus on the summary and overall ruling—namely, the obligation to fulfill the oath, the prohibition of its violation, and the obligation of expiation (Kaffārah)—the question that arises is whether the violation of an oath is always prohibited and subject to expiation, or whether Islamic jurisprudence provides other prescriptive rulings for violating a contractual oath in its various instances. An examination of their jurisprudential opinions reveals that some jurists consider the prescriptive ruling on violating an oath to be contingent upon the subject matter of the oath in accordance with the five categories of rulings (Al-Aḥkām al-Khamsah), while others deem it dependent on whether the oath is binding (īqā‘) or non-binding. There is no disagreement among jurists regarding the ruling on a prohibitory (Mawlawī) or directive (Irshādī) prohibition against violating an oath whose subject matter is preferable (Rājiḥ)—i.e., where the subject of the oath is obligatory, recommended, or permissible with a preferable aspect—and all concur that expiation is obligatory in the event of violating such an oath. However, the point of contention lies in the case of a non-preferable (Marjūḥ) subject matter of a contractual oath, where there is disagreement regarding the formation of the oath itself and, consequently, the prescriptive ruling on its violation. Therefore, upon deeper reflection on their views and arguments, the first opinion—which considers the binding nature of a contractual oath concerning a preferable subject matter and the prohibition of its violation, and the non-binding nature concerning a non-preferable subject matter, thereby excluding it Takhassuṣan from the scope of oath-related rulings—appears to be closer to the correct view.</Abstract>
			<OtherAbstract Language="FA">فقهای مذاهب اسلامی در حکم تکلیفی حنث یمین عقدی اختلاف‌نظر دارند. اگرچه در حکم اجمالی و کلی آن که وجوب عمل به یمین و حرمت حنث و وجوب کفاره است، اجماع نظر وجود دارد، اما سؤالی که به ذهن متبادر است این است که آیا همیشه نقض یمین حرام بوده و مستوجب کفاره است؟ یا اینکه در فقه اسلامی برای حنث یمین عقدی احکام تکلیفی دیگری در مصادیق متعدد آن وجود دارد؟ با بررسی آراء فقهی آنان فهمیده می‌شود که برخی از فقها حکم تکلیفی حنث یمین را با توجه به متعلق یمین تابع احکام خمسه و برخی دیگر تابع ایقاع و عدم ایقاع یمین دانسته‌اند. اختلاف‌نظری میان فقها در حکم به نهی مولوی یا ارشادی از حنث یمینی که متعلق آن راجح است (یعنی متعلق واجب، مستحب و مباحی که طرف یمین آن رجحان دارد) وجود ندارد و همگی حکم به وجوب کفاره در صورت حنث یمین با متعلق راجح کرده‌اند. اما محل اختلاف در متعلق مرجوح یمین عقدی است که در انعقاد یمین و بالتبع، حکم تکلیفی حنث آن اختلاف‌نظر وجود دارد. لذا با تعمق در نظرات و ادله آنها، دیدگاه اول که ایقاع یمین عقدی در متعلق راجح و حکم به حرمت حنث آن را و عدم ایقاع را در متعلق مرجوح و خروج آن تخصصاً از بحث یمین، ملاک حکم تکلیفی حنث یمین می‌داند، به قول صواب نزدیک‌تر است.</OtherAbstract>

		<Abstract>One of the most important duties of a jurist is to investigate the general jurisprudential rules (Al-Qawā‘id al-Fiqhiyyah) that are employed in numerous specific issues and in the derivation of legal rulings. These rules serve as guiding principles in resolving many problems, and in the case of newly emergent issues (Masā’il Mustaḥdathah) for which no specific textual evidence (Naṣṣ) exists, the jurist relies on them to issue fatwas. The jurisprudence of tourism is one such example of these novel and emerging issues. This study, employing a descriptive-analytical method, examines the jurisprudential rules of tourism as articulated in the Imamiyyah denomination and the four Sunni denominations of jurisprudence, along with the evidence substantiating them. The findings indicate the efficacy of jurisprudential rules in the fatwas of Imamiyyah jurists and the muftis of Islamic denominations. Furthermore, by mastering these jurisprudential rules, one can derive the rulings on newly emergent issues. To this end, the study first addresses important jurisprudential rules in the Imamiyyah denomination—such as the rule of negation of dominion (Qā‘idat Nafy al-Sabīl), the rule of possession (Qā‘idat al-Yad), and others—along with their supporting evidence from the Qur’an, Sunnah, reason, and consensus (Ijmā‘). Subsequently, rules from the perspective of the four Sunni denominations are elucidated. In the present study, the various views of Imamiyyah jurists and Sunni muftis have been collected without weighing them against one another, with the aim of highlighting points of commonality on the subject of tourism as a subsidiary issue. Additionally, the common instances found therein have been examined within the framework of civil law and constitutional law.</Abstract>
			<OtherAbstract Language="FA">یکی از مهم‌ترین وظایف فقیه تفحص در قواعد کلی فقهی‌ است که در بسیاری از موضوعات جزئی و استنباط احکام استفاده می‌شود. این قواعد در حل بسیاری از مشکلات راه‌گشاست و در مسائل مستحدثه که نصی در آن موضوع خاص وارد نشده فقیه از آنها برای فتوا دادن استفاده می‌نماید که فقه گردشگری یکی از مسائل مستحدثه و نوپیدا از آن مثالهاست. این پژوهش با روش توصیفی ـ تحلیلی به بررسی قواعد فقهی گردشگری مطرح‌شده در امامیه و مذاهب اربعه اهل‌سنت و ادله اثبات آنها می‌پردازد. نتایج نشان از کارآمدی قواعد فقهی در فتاوای فقیهان امامیه و مفتیان مذاهب اسلامی بوده است. هم‌چنین با احاطه بر قواعد فقهی می‌توان حکم مسائل مستحدثه را به دست آورد. بدین منظور ابتدا به قواعد مهم فقهی در امامیه نظیر قاعده نفی سبیل، قاعده ید و... و ادله اثبات آن از کتاب، ‌سنت، عقل و اجماع اشاره شده و سپس قواعدی از دیدگاه مذاهب اربعه تبیین گردیده است. در پژوهش حاضر دیدگاههای مختلف هر کدام از فقهای امامیه و مفتیان اهل‌سنت بدون موازنه بین آنها با هدف بیان موارد اشتراکی در موضوع گردشگری به‌عنوان یک مسئله فرعی گردآوری شده و هم‌چنین مصادیق مشترک موجود در آنها در حقوق مدنی و قانون اساسی بررسی شده است.</OtherAbstract>

		<Abstract>The novelty of the term “crime against humanity” in international law raises the question of what its nature and criteria are in jurisprudence, and what evidence exists to demonstrate that crimes against humanity are prohibited in comparative jurisprudence. To answer this question, the concept of humanity must be explored within jurisprudential anthropology so that a crime against it can be conceived. The present study, by collecting library resources from Islamic denominations of jurisprudence and employing a descriptive-analytical method, seeks to address a question that holds both fundamental and practical significance in the international arena. It is deduced from the sources of jurisprudence that the nature of a crime against humanity is anything that conflicts with the purposes of human creation, namely, being the vicegerent of God (Khalīfat Allāh). The criterion of a crime against humanity in the jurisprudence of Islamic denominations is the existence of a widespread, numerous, and deliberate attack on the essential purposes of the Sharia (Maqāṣid al-Sharī’ah)—namely, religion, life, intellect, honor, lineage, and property. As a result, the value and dignity of humanity are assaulted, and obstacles are created in achieving the goals of human creation. The proofs for the prohibition of crimes against humanity in comparative jurisprudence include Qur’anic verses, hadiths, analogical reasoning (Qiyās), custom (&#039;Urf), and the rational method (Sīrat al-‘Uqalā’), all of which indicate its prohibition and the legitimacy of punishing the perpetrators.</Abstract>
			<OtherAbstract Language="FA">مستحدثه بودن عنوان ارتکابی «جنایت علیه بشریت» در حقوق بین‌الملل، این سؤال را ایجاد می‌کند که ماهیت و ملاک آن در فقه چیست و چه ادله‌ای بر حرمت جنایت علیه بشریت در فقه مقارن وجود دارد. برای دست‌یافتن به جواب این پرسش، باید مفهوم بشریت در انسان‌شناسی فقهی کنکاش شود تا جنایت علیه او قابل تصور باشد. پژوهش حاضر با جمع‌آوری منابع کتابخانه‌ای از مذاهب اسلامی و به روش توصیفی ـ تحلیلی در پی پاسخ به پرسشی است که جنبه بنیادی و کاربردی در عرصه بین‌الملل دارد. با تدبر در منابع فقه چنین استنباط می‌شود که ماهیت جنایت علیه بشریت، هر آن چیزی است که با اهداف خلقت انسان بماهو انسان به معنی خلیفةالله در تضاد باشد. ملاک جنایت علیه بشریت در فقه مذاهب اسلامی این است که تهاجم گسترده و متعدد و عمدی به مقاصد ضروری شریعت یعنی دین، نفس، عقل، عِرض، نسب و مال صورت پذیرد که در اثر آن به ارزش و مقام انسانیت هجمه وارد می‌شود و در رسیدن انسانها به اهداف خلقت بشری مانع ایجاد می‌کند. ادله حرمت جنایت علیه بشریت در فقه مقارن، شامل آیات، روایات، قیاس، عرف و بنای عقلاست که بر حرمت آن و مشروعیت مجازات مرتکبین دلالت دارد.</OtherAbstract>

		<Abstract>Today, the focus has shifted from the legality of crimes and punishments to the legality of criminal law, encompassing the legality of jurisdiction and procedure. The accused are shielded from punishment based on the principle of acquittal (Aṣālat al-Barā’ah); thus, “reason” serves as the sole tool for judges to uncover facts related to the crime and attribute them to the accused. In light of this, the present paper employs a descriptive-analytical method to address the primary question regarding the nature and jurisprudential ruling of utilizing DNA fingerprinting for criminal purposes in contemporary Islamic jurisprudence. The perspectives of Shia and Sunni scholars on the nature of DNA testing or fingerprinting—including sensory evidence or evidence closely aligned with the documented knowledge of the judge, sensory matters in acquiring knowledge for various individuals, Bayyinah (clear proof), Luth (circumstantial evidence), technical or persuasive evidence, definitive evidence, and scientific degrees based on experience—are all subject to the authority of the judge. Their views on DNA fingerprinting for criminal purposes can be categorized into conditional permission, absolute permission, non-permissibility, and adherence to national laws regarding permissibility and non-permissibility. Verses such as 18 of Sūrat Yūsuf, the Sunnah, rational indications, and common sense support its permissibility for criminal purposes, whereas verses such as 15 of Sūrat al-Nisā’, 4 of Sūrat al-Nūr, 3 of Sūrat al-Mā’idah, and 229 of Sūrat al-Baqarah, along with the Sunnah, highlight the lack of validity of the judge’s knowledge within Ḥudūd, divine tolerance within Ḥudūd, the rule of Dar’ (avoidance of punishment in cases of doubt), and the principle of acquittal as evidence for its non-permissibility. The theory of permissibility appears to take precedence over the theory of impermissibility, considering the weaknesses in the opposing arguments and a thorough examination of the aspects of DNA fingerprinting as a subject matter.</Abstract>
			<OtherAbstract Language="FA">امروزه به‌جای اصل قانونی‌بودن جرایم و مجازات، سخن از اصل قانونی‌بودن حقوق جزا است تا این اصل صلاحیت مراجع رسیدگی و آیین رسیدگی را در بر بگیرد. متهمان به پشتوانه اصل برائت مصون از کیفر هستند؛ بنابراین «دلیل» تنها ابزارِ دادرسان برای کشف واقعیتهای مربوط به جرم و انتساب آن به متهم است. بر همین مبنا، این پژوهش با روش توصیفی ـ تحلیلی در پی پاسخ‌گویی به این سؤال است که ماهیت و حکم فقهی استفاده از انگشت‌نگاری دی ان ای در فقه مقارن چیست؟ نظرات فقیهان امامیه و اهل‌سنت درباره ماهیت آزمایش یا انگشت‌نگاری دی ان ای شامل قرائن حسّی یا قریب به حسِ مستندِ علمِ قاضی، امر حسی در حصول علم برای نوع مردم، بینه، لوث، ادله فنی یا اقناعی یا قرائن، ادله قطعی، مدرک علمی مبتنی بر تجربه و مشمول اختیارات قاضی هستند. نظرات آنان درباره حکم انگشت‌نگاری دی ان ای برای اهداف کیفری به جواز مشروط، جواز مطلق، عدم جواز و تابعیت از قوانین کشور در جواز و عدم جواز قابل‌تقسیم است و آیه 18 یوسف، سنت، دلیل عقل و بنای عقلا از ادله جواز آن با اهداف کیفری و آیات 15 نساء، 4 نور، 3 مائده و 229 بقره، سنت، عدم حجیت علم قاضی در حدود، تسامح الهی در حدود، قاعده درأ و اصل برائت از ادله عدم جواز آن هستند. به نظر می‌رسد نظریه جواز با توجه به ضعف ادله طرف مقابل و بررسی ابعاد دقیق انگشت‌نگاری دی ان ای به عنوان موضوع‌شناسی بر نظریه عدم جواز اولویت دارد.</OtherAbstract>

		<Abstract>In Islamic jurisprudence, two interconnected issues related to the multiplicity of crimes have been raised: first, the determination of punishment, and second, the order of execution of penalties. Many studies have been conducted regarding the first issue, but the latter has been largely overlooked and has not been sufficiently addressed. Therefore, examining the order of punishment execution and the principles governing it in Imāmī and Ḥanafī jurisprudence is one of the main objectives of this research. The findings of this study, conducted using a descriptive-analytical method, indicate that in Imāmī jurisprudence (absolutely) and in Ḥanafī jurisprudence (with the acceptance of exceptions), the order of punishment execution is justified in light of three general principles. First, the principle of the necessity of executing all punishments. Second, the principle of prioritizing the rights of individuals over the rights of God. Third, the principle of the immediate execution of punishments pertaining to the rights of God. Thus, if all punishments are for the rights of God, the principle is to execute all of them, unless it is not possible to carry out all of them. In such cases, punishments are executed first that do not interfere with the execution of other punishments. This principle also applies to the execution order for the rights of individuals. However, in the case of combining punishments for the rights of God and the rights of individuals, if the punishments can be combined, in Imāmī jurisprudence, according to the principle of immediate execution of punishments for the rights of God, the punishments for the rights of God are executed first. If they cannot be combined (conflict between the punishments for the rights of God and the rights of individuals), the principle is to prioritize the punishments for the rights of individuals over the rights of God. In Ḥanafī jurisprudence, in both cases, punishments for the rights of individuals take precedence over the rights of God.</Abstract>
			<OtherAbstract Language="FA">در فقه اسلامی دو مسئله پیوسته درباره تعدد جرم مطرح شده است. نخست نحوه تعیین مجازات و دوم چگونگی ترتیب اجرای کیفر. در مورد مسئله نخست پژوهشهای زیادی صورت‌ گرفته است، اما مسئله اخیرالذکر از امور مغفول است که تا امروز به آن پرداخته نشده است؛ بنابراین پرداختن به ترتیب اجرای مجازات و اصول حاکم برآن در فقه امامیه و حنفی از اهداف اساسی این تحقیق است. یافته‌های این تحقیق با روش توصیفی ـ تحلیلی بیانگر آن است که در فقه امامیه (به طور مطلق) و در فقه حنفی (با پذیرش استثناء) ترتیب اجرای مجازات در پرتو سه اصل کلی توجیه شده است. نخست اصل ضرورت اجرای همه مجازات. دوم، اصل تقدم حق‌الناس بر حق‌الله، سوم اصل اجرای فوری مجازات حق‌الله. به‌این‌ترتیب چنانچه همه مجازات حق‌الله باشد اصل بر اجرای همه مجازات است مگر اینکه اعمال همه آنها ممکن نباشد و نخست کیفرهایی اجرا می‌شوند که موجب از بین رفتن زمینه سایر مجازاتها نگردد. در ترتیب مجازات حق‌الناس نیز این اصل حاکم است. اما در فرض جمع مجازات حق‌الله و حق‌الناس، چنانچه مجازاتها قابل‌جمع باشند، در فقه امامیه برابر اصل اجرای فوری مجازات حق‌الله، ابتدا کیفرهای حق‌الله اجرا می‌گردد و هرگاه قابل‌جمع نباشند (تزاحم مجازات حق‌الله و حق‌الناس) اصل بر تقدم مجازات حق‌الناس بر حق‌الله است. در فقه حنفی در هر دو صورت مجازات حق‌الناس بر حق‌الله مقدم است.</OtherAbstract>

		<Abstract>The rule of statute of limitations in positive law is part of procedural and mandatory rules that limit the judicial power of courts in relation to lawsuits over a certain period. This rule refers to the expiration of a period after which a claim can no longer be pursued or adjudicated. Since the obligation to preserve documents and records indefinitely is neither logical nor rational, and considering that the passage of time results in the loss of evidence, not accepting the statute of limitations would cause harm to the defendant and would also present challenges for judges in ensuring justice. Therefore, most legal systems around the world have enacted rules under the title of statute of limitations to prevent the pursuit of stale claims. The Civil Procedure Law of Iran and the Civil Code of Afghanistan also contain provisions regarding the statute of limitations. The majority of classical Imāmī jurists and some Sunni scholars were initially of the opinion that the statute of limitations is not legitimate. However, after the Guardian Council declared the statute of limitations to be contrary to Islamic law by a majority vote, the debate on its legitimacy became more prominent. Some scholars provided arguments in favor of its legitimacy, while others argued against it. This research, using a descriptive-analytical method and library resources from both Imāmī and Sunni jurisprudence, aims to review the viewpoints and arguments of both sides and identify the perspective that is more in line with Islamic principles and public interests. The findings of this study indicate that the statute of limitations in Imāmī jurisprudence, based on certain narrations and legal principles such as the rules of negligence (Tafrīṭ), abandonment (Ihmāl) and waiver (Isqāṭ), acquisition (Ḥiyāzat), governmental rulings (Aḥkām Ḥukūmatī), and the rational necessity of maintaining social order, is considered legitimate. In Sunni jurisprudence, it is deemed acceptable and legitimate based on evidence from tradition (Sunnah), reason (‘Aql), the rule of blocking harmful pathways (Sadd al-Dharā’i’), and the principle of the ruler’s command (al-Amr al-Sulṭānī).</Abstract>
			<OtherAbstract Language="FA">قاعده مرور زمان، در حقوق موضوعه جزء قواعد شکلی و آمره‌ای است که قدرت قضایی محاکم را در پیوند به دعاوی به زمانی محدود می‌سازد. این قاعده، به مفهوم منقضی شدنِ مدتی است که به موجب قانون با سپری شدن آن دعوی قابل تعقیب و رسیدگی نیست. از آنجا که تکلیف به نگهداری اسناد و مدارک برای همیشه، عملی غیرمنطقی و غیرعقلانی است و با توجه به اینکه گذشت زمان موجب از بین رفتنِ مدارک اثباتی می‌شود، بنابراین عدم پذیرش مرور زمان سبب ورود خسارت به خوانده دعوی می‌گردد و از طرفی احقاق حق توسط قضات نیز با چالش روبه‌رو خواهد بود. از همین جهت بیشتر نظامهای حقوقی جهان قواعدی را تحت عنوان مرور زمان به منظور جلوگیری از دعاوی کهنه وضع نمودند. قانون آیین دادرسی مدنی ایران و قانون مدنی افغانستان نیز در مورد قاعده‌ مرور زمان، مقرراتی وضع نموده‌اند. جمهور فقهای متقدم امامیه و برخی فقهای اهل‌سنت معتقد به عدم مشروعیت مرور زمان بودند؛ اما بعد از اینکه شورای محترم نگهبان به اکثریت آراء مرور زمان را خلاف شرع اعلام کردند، باب جدل در مورد مشروعیت و عدم مشروعیت آن بیشتر گشوده شد: برخی بر مشروعیت مرور زمان و عده‌ای بر ممنوعیت آن دلایل ارائه کردند. این تحقیق با روش توصیفی ـ تحلیلی و با استفاده از منابع کتابخانه‌ای فقه امامیه و اهل‌سنت در صدد بررسی دیدگاهها و دلایل طرفین و تشخیص دیدگاهی است که از نظر مبانی شرعی راجح و با مصالح عمومی سازگارتر باشد. یافته‌های این تحقیق نشان می‌دهد که مرور زمان در فقه امامیه با استناد به برخی روایات و قواعدی فقهی همچون قاعده‌ اعراض، اسقاط و ابراء، حیازت، حکم حکومتی و قاعده‌ عقلی ضرورت حفظ نظام اجتماعی و در فقه اهل‌سنت به استناد دلایلی از سنت، عقل، قاعده سد ذرایع و قاعده‌ امر سلطانی، مشروع و قابل پذیرش است.</OtherAbstract>

		<Abstract>The purpose of this study is to evaluate the criteria that may be utilized in understanding the content of medical narrations (Riwāyāt Ṭibbiyyah). This article has been written using a descriptive-analytical method, drawing upon library resources and referring to the verses of the Holy Qur’an, as well as books of narrations, exegesis (Tafsīr), principles of jurisprudence (Uṣūl al-Fiqh), and articles related to the subject matter. The findings indicate that Islamic sciences—such as the preliminaries of Uṣūl al-Fiqh and certain sections thereof, the science of narrators (Rijāl), the science of hadith criticism (Dirāyat al-Ḥadīth), logic, lexicology, exegesis, history, and others—are generally capable of identifying the purposes of medical narrations. However, certain topics, such as the principle of leniency in the evidence for recommended acts (Tasāmuḥ Fī Adillat al-Sunan), due to a lack of functional congruence and an inability to justify the validity of medical-narrative propositions, will not lead us to the desired goal. Various opinions have been presented regarding whether medical narrations are of an external (Khārijiyyah) or factual (Ḥaqīqiyyah) nature with respect to the content of medical science, wherein the presence of determining contextual clues (Qarā’in) proves useful, and it becomes clear that at least many of these narrations possess a factual dimension. The empirical testability of the content of medical narrations, given their directive (Irshādī) aspect concerning health, is not prohibited; and even if there exists a possibility of the obligation of heartfelt commitment to the Sunnah, this option is ruled out with respect to medical narrations. However, given that medical narrations were issued within the context of humoral (Mizāj-based) medicine, empirical testing based on this foundation should not be overlooked in order to achieve more precise results—although alignment with experimentation based on modern laboratory and clinical sciences can also be effective in benefiting from narrative traditions. Thus, the relationship between Islamic jurisprudence and empirical experience in this field is a bidirectional one.</Abstract>
			<OtherAbstract Language="FA">هدف از این پژوهش، ارزیابی ملاکهایی است که گمان می‌رود بتوان در فهم مفاد روایات طبی از آنها بهره‌مند شد. نوشتار پیش رو به روش توصیفی ـ تحلیلی، با استفاده از منابع کتابخانه‌ای و با مراجعه به آیات قرآن کریم، کتابهای روایی، تفسیری، اصولی و هم‌چنین مقالات مرتبط با موضوع متن، نگاشته شده است. یافته‌ها بیانگر آن است که علوم اسلامی همچون مقدمات اصول فقه و برخی بخشهای آن، رجال‌شناسی و درایه‌الحدیث، منطق، واژه‌شناسی، تفسیر، تاریخ و... به‌طور کلی توانایی شناسایی مقاصد روایات طبی را برخوردار است؛ اما مباحثی مانند تسامح در ادله‌ سنن به دلیل عدم سنخیت کارکردی و ناتوانی در توجیه اعتبار گزاره‌های طبی روایی، ما را به هدف نخواهد رساند. در دوران خارجیه یا حقیقیه بودن روایات با مفاد علم طب نظرات مختلفی ارائه شده که وجود قرائن تعیین‌کننده، در این زمینه سودمند است و روشن می‌شود دست‌کم بسیاری از روایات جنبه‌ حقیقی دارند. تجربه‌پذیری مفاد روایات طبی با توجه به جنبه‌ ارشادی آنها در زمینه‌ سلامت ممنوعیتی ندارد و حتی با وجود احتمال وجوب التزام قلبی به سنت این گزینه در حق روایات طبی منتفی است، اما با توجه صدور روایات طبی در بستر طب مزاج پایه، برای دستیابی به نتایج دقیق‌تر، تجربه بر این اساس را نباید نادیده گرفت؛ اگرچه همراهی با تجربه بر اساس علوم آزمایشگاهی و بالینی جدید نیز می‌تواند در بهره‌برداری از سنتهای روایی مؤثر باشد؛ بنابراین رابطه میان فقه اسلامی و تجربه در این زمینه، رابطه‌ای دوسویه است.</OtherAbstract>
