Since the word Ain is defined in contrast to “interest” and “right” by Shi’ite jurisprudents and to “debt” by Sunni scholars, the question is whether intangible assets can also be transmitted in the form of a contract of sale. If yes, it will be possible to achieve an integrated legal resolution by implementing sale-related laws and rules in these cases and by preventing disagreements on this issue. By reviewing basic jurisprudential and legal conceptions of sale, object, property and right, the present study concludes that, considering the popular nature of sale and the materiality of some intangible properties in the eye of the public as well as the problematic extension of the word object to include intangible properties, it is necessary to revise the definition of sale. Convinced that the objectivity of the object of sale is not an exclusionary condition, some Hanafi, Shafi’i and Hanbali jurisprudents use the word property instead of Ain (object) to resolve the problem of the popular norm.}, keywords = {sale,Ain (object),Intangible Assets,Right,Islamic Jurisprudence,civil code}, title_fa = {بازپژوهی بیع اموال غیرمادی در فقه اسلامی و حقوق ایران}, abstract_fa = {قانون مدنی در ماده 338 به پیروی از گروهی از فقیهان امامی، بیع را به «تملیک عین به‌عوض معلوم» تعریف کرده است. ازآنجاکه کلمه «عین» در اصطلاح فقیهان امامی در مقابل «منفعت» و «حق» و از دیدگاه برخی فقیهان اهل سنت در مقابل «دِین» به ‌کار رفته، این سؤال مطرح می‌شود که آیا اموال غیرمادی هم می‌تواند در قالب عقد بیع منتقل گردد؟ اگر پاسخ به این سؤال مثبت باشد، می‌توان با اجرای احکام و قواعد مربوط به بیع در این موارد، ضمن پیشگیری از صدور آرای متفاوت ناشی از اختلاف ‌نظر در این زمینه، موجبات یکپارچگی قواعد حقوقی را فراهم‌آورد. این جستار با نقد و بررسی فقهی و حقوقی مفاهیم اساسی بیع، عین، مال و حق، به این نتیجه دست ‌یافته است که با توجه به عرفی‌بودن حقیقت بیع و مالیت‌داشتن برخی از اموال غیرمادی از دیدگاه عرف امروزی و گسترش مفهوم عین به منظور دربرگرفتن امور غیرمادی و ناسازگاری آن با مفهوم حقیقی عین، باید در تعریف بیع تجدید نظر کرد و با اعتقاد به عدم لزوم عینیت مبیع، همچون برخی از فقیهان حنفی، شافعی و حنبلی به ‌جای واژه عین در تعریف بیع از واژه مال استفاده نمود و از این طریق به تشخیص عرف نیز ترتیب اثر داد.}, keywords_fa = {بیع,عین,اموال غیرمادی,حق,فقه اسلامی,حقوق مدنی}, url = {https://fiqhemoqaran.mazaheb.ac.ir/article_42402.html}, eprint = {https://fiqhemoqaran.mazaheb.ac.ir/article_42402_a8bd45a9da30c6bf01b1ba3d9e364fd2.pdf} }
