This shared belief itself is rooted in another principle discussed in all schools of jurisprudence; namely, the idea that the legitimacy and integrity of an act is subject to the belief in Wilayah. No matter if it is the act of an individual person relating to himself/ herself or to others or the act of all individuals in a community, a whole society, the act must be carried out with the belief in Wilayah. The presence of a person who can run the society with Wilayah is essential. Necessarily or preferably, the person who takes the responsibility to manage public affairs must be a Faqih (Islamic jurisprudent). As a result, the ruler of a society in Islamic law has the two features of Wilayah (guardianship) and Fiqahah (jurisprudence), with the ruler called Wali al-Faqih and the government called Wilayat al-Faqih.}, keywords = {Wilayat al-Faqih (guardianship of Islamic Jurisprudent),private affairs,Public Affairs,guardian,Imamat al-Kubra (great leadership),Imam al-Aʿzam (great leader)}, title_fa = {ولایت فقیه از دیدگاه مذاهب فقهی اسلامی}, abstract_fa = {یکی از اصیل‌ترین فکرهای اسلامی که همه مذاهب فقهی به آن باور دارند، اعتقاد به «ولایت فقیه» است. ریشه این باور مشترک اصل دیگری است که در همه مذاهب فقهی مطرح شده وآن این است که شرعیت و صحت عمل منوط به ولایت است؛ فرقی نمی‌کند که آن عمل به آحاد و افراد جامعه مربوط باشد و فعل فرد خاص و مربوط به خودش باشد یا به دیگری، باید با داشتن ولایت انجام گیرد یا آنکه آن عمل به عموم مردم و جامعه مربوط باشد. برای جامعه حضور کسی که با داشتن ولایت جامعه را اداره کند، ضروری است. ضرورتاً یا رجحاناً کسی که متصدّی امور عمومی می‌شود، باید «فقیه» باشد؛ درنتیجه کسی که جامعه را اداره می‌کند، دارای دو وصف ولایت و فقاهت است که او را «ولی فقیه» می‌گویند و نظامی که بر این اساس به وجود می‌آید، نظام «ولایت فقیه» است.}, keywords_fa = {ولایت فقیه,امور خصوصی,امور عمومی,ولی امر,امامت کبری,امام اعظم}, url = {https://fiqhemoqaran.mazaheb.ac.ir/article_32856.html}, eprint = {https://fiqhemoqaran.mazaheb.ac.ir/article_32856_31676ff3cbdf10218c6ccd307faa6e7d.pdf} }
