This article has proved the second promise by referring to Quranic, narrative, rational evidences as well as the theory of “consolation of heart”. The aim of the research is to prove that the unpopular theory, that the right to retribution for the owners of blood does not expire with the consent of the victim before his death, and the owners of blood of the deceased can demand retribution or blood money after the death of the victim. The result of this research is the analysis of Article 365 of the new Penal Code, from a criminological point of view and proving that the right of retribution does not expire with the consent of the victim before his death, and the owners of blood of the deceased can demand retribution or blood money after the death of the victim.}, keywords = {Article 365 of the Iranian Penal Code,The Victim (Majni Alayh),Owner of Blood (Wali-e Dam),Consolation of Heart}, title_fa = {واکاوی فقهی حقوقی مالک حق قصاص و تطبیق آن با موازین فقهی امامیه و اهل‌سنت با رویکردی به ماده 365 قانون مجازات اسلامی (مصوب 1392)}, abstract_fa = {این پژوهش، به روش توصیفی تحلیلی، ماده 365 قانون مجازات اسلامی جدید را در دو نظریه ذیل نقد و بررسی کرده است: الف) قول مشهور که قانون مجازات جدید بر اساس آن تنظیم شده و حق عفو از قصاص را برای مجنی‌علیه پذیرفته است؛ ب) قول غیرمشهور که ماده 54 قانون مجازات اسلامی سابق بر اساس آن تنظیم شده و حق عفو را متعلق به اولیای دم دانسته است. این نوشتار با استناد به ادله قرآنی، روایی، عقلی و هم‌چنین نظریه تشفی‌خاطر، قول دوم را به اثبات رسانده است. هدف تحقیق اثبات نظریه مخالف مشهور است، مبنی بر اینکه با گذشتِ مجنی‌علیه قبل از فوت، حق قصاص ساقط نمی‌شود و اولیای دم می‌توانند پس از فوت مجنی‌علیه، مطالبه قصاص یا دیه نمایند. نوآوری این پژوهش، تحلیل ماده 365 قانون مجازات جدید با نگاهی جرم‌شناسانه می‌باشد و اثبات اینکه با گذشت مجنی‌علیه قبل از فوت، حق قصاص ساقط نمی‌شود و اولیای دم می‌توانند پس از فوت مجنی‌علیه، مطالبه قصاص یا دیه نمایند.}, keywords_fa = {ماده 365 قانون مجازات,مجنی‌علیه,ولی‌دم,تشفی خاطر}, url = {https://fiqhemoqaran.mazaheb.ac.ir/article_166469.html}, eprint = {https://fiqhemoqaran.mazaheb.ac.ir/article_166469_abf8eec1cdce0dfab82bab705caf7b95.pdf} }
