The origin for many developments in the field of civil liability has been the attempt to maximum compensation for losses and not leaving any damages to persons without remedy. An examination of the criteria of tortious liability in Islamic jurisprudence shows that this system of thought and its capacities are rich enough to fully compensate for the undue losses inflicted on persons. However, some legal writers consider the scope of material compensable losses in Islamic jurisprudence to be very limited and they believe that moving around the jurisprudence circuit in the field of civil liability would mean leaving many material losses to individuals without compensation. Investigating the reasons and evidences of this claim and a comprehensive examination of the subject in various  Islamic schools of thought shows that this theory disregards the reality of the views expressed in jurisprudence of  Islamic schools of thought, because this limitation of the idea for compensation is mainly due to the Hanafi jurisprudence, which sometimes due to its narrow interpretation of considering objects as property and sometimes for specific jurisprudential reasons or specific interpretation of certain rules in Islamic jurisprudence, has practically limited the circle of the losses to financial affairs, that cannot be generalized to all Islamic sects. Though, the scope for recoverable financial losses are not the same in other Islamic schools of thought.}, keywords = {Tortious Liability,Civil Liability,Material Losses,Compensation for Losses}, title_fa = {قلمرو ضمان در فقه مذاهب اسلامی (در امور مالی)}, abstract_fa = {شاید بتوان تلاش برای جبران کامل زیانهای وارده بر زیاندیدگان را محوری‌ترین اصل حاکم بر مسئولیت مدنی دانست. سرچشمه بسیاری از تحولات حوزه مسئولیت مدنی، تلاش برای جبران حداکثری خسارات و بی‌جبران نماندن زیانهای وارده به اشخاص بوده است. بررسی ضوابط ضمان قهری در فقه اسلامی نشان می‌دهد که این نظام فکری و ظرفیتهای موجود در آن از غنای کافی برای جبران کامل خسارات ناروای وارد بر اشخاص برخوردار است. با این همه برخی نویسندگان حقوقی، قلمرو زیان مادی قابل جبران در فقه اسلامی را بسیار محدود دانسته و معتقدند حرکت بر مدار فقه اسلامی در حوزه مسئولیت مدنی، به معنای بی‌جبران ماندن بسیاری از خسارات مادی وارد بر اشخاص خواهد بود. توجه به دلایل و مستندات ادعای یادشده و بررسی همه‌جانبه موضوع در مذاهب مختلف اسلامی نشان از بی‌توجهی این نظریه به واقعیت موجود در دیدگاههای مطرح در فقه مذاهب اسلامی دارد، چرا که محدودیت اندیشه جبران، عمدتاً ناظر به فقه حنفی است که گاه به دلیل تفسیر مضیق ایشان از مال تلقی شدن اشیاء و گاه به دلایل خاص فقهی یا تفسیر ویژه از برخی قواعد مطرح در فقه اسلامی، عملاً دایره زیانهای وارده به امور مالی را محدود کرده است که این امر قابل تعمیم بر همه فرق اسلامی نیست. هرچند قلمرو زیان مالی قابل جبران در سایر مذاهب اسلامی نیز یکسان نیست.}, keywords_fa = {ضمان قهری,مسئولیت مدنی,زیان مادی,جبران ضرر}, url = {https://fiqhemoqaran.mazaheb.ac.ir/article_122991.html}, eprint = {https://fiqhemoqaran.mazaheb.ac.ir/article_122991_c2dcc27760280a8adebb7f9beae77050.pdf} }
