The majority of the Sunni jurisprudents have considered that divorce is correct, but in Imami jurisprudence such a deed is not correct. Accepting the correctness of transmitting the right to divorce is not inconsistent with the general rules of agreements and contracts, and does not appear to contravene marriage, even though it is not in consistence with the purpose of marriage, which is to get pleasure from and to transcend generations. In any case, because of the traditions that do not consider this act to be correct, it must have been believed to be inaccurate, and it must be accepted that the wife’s willingness to split the marriage by paying to the husband in the form of Khul‘ Divorce or Mubarat Divorce can be acceptable. There are various possibilities regarding the nature of transmitting the right to divorce, and according to verses 28 and 29 of Surah al-Ahzab, it can be said that transmitting the right to divorce is a non-binding commitment to divorce that the husband can revert from. Transmitting the right to divorce, as an independent legal entity, is accepted by the majority of Sunnis, although in Imami jurisprudence, although it has a number of supporters, it has not been accepted, and the fairness is that the verses 28 and 29 of the Surah al-Ahzab are specific to the Holy Prophet of Islam and they do not have any signification to the concept of transmitting the right to divorce.}, keywords = {Transmitting the Right to Divorce,Giving the Possession of the Right to Divorce,Divorce,jurisprudence of Islamic Denominations,nature}, title_fa = {بررسی ماهیت و صحت یا عدم صحت تخییر و تملیک طلاق به زوجه در فقه مذاهب اسلامی}, abstract_fa = {مسئله تخییر زوجه در طلاق و تملیک حق طلاق به زوجه از جمله مباحث اختلافی بین مذاهب اسلامی است؛ در فهم معنای تملیک بین فقهای مذاهب اسلامی اختلاف نظر است؛ می­‌توان گفت آنچه از تملیک برداشت می­‌شود این است که تملیک طلاق از نظر ماهیت یک عمل حقوقی دوطرفه­ و الزام­‌آوری است که در آن امکان انجام فعل طلاق به زوجه سپرده می­‌شود، به نحوی که بتواند به اراده مستقل خود، خود را مطلقه سازد. اکثریت فقهای اهل­‌سنت تملیک طلاق را صحیح دانسته­‌اند و لکن در فقه امامیه چنین عملی صحیح دانسته نشده است. قبول صحت تملیک طلاق با قواعد عمومی عقود و ایقاعات مغایرتی ندارد و خلاف مقتضای نکاح به نظر نمی­‌رسد، هر چند که مغایرت با هدف و غایت از زوجیت که تمتع التذاذی و تولید نسل است، دارد. در هر صورت به جهت وجود روایاتی که چنین عملی را صحیح نمی­‌دانند می­‌بایست معتقد به عدم صحت تملیک بود و باید پذیرفت که سهیم­‌بودن اراده زوجه در طلاق با پرداخت مالی از سوی او به زوج و در قالب خلع یا مبارات قابل پذیرش است. در مورد ماهیت تخییر احتمالات مختلفی بیان شده است و با توجه به آیات 28 و 29 سوره مبارکه احزاب می­‌توان گفت تخییر تعهد یک­‌طرفه غیرالزام­‌آور نسبت به طلاق است که زوج می­‌تواند از آن رجوع کند. تخییر به عنوان یک نهاد حقوقی مستقل مورد پذیرش اکثریت اهل­‌سنت است و در فقه امامیه هر چند موافقان انگشت­‌شماری دارد، اما پذیرفته نشده است و انصاف این است که آیات 28 و 29 سوره احزاب علاوه بر اینکه در فقه امامیه جزو اختصاصات نبی مکرم اسلام(ص) دانسته شده است، دلالتی بر تخییر ندارند.}, keywords_fa = {تخییر,تملیک,طلاق,فقه مذاهب اسلامی,ماهیت}, url = {https://fiqhemoqaran.mazaheb.ac.ir/article_105986.html}, eprint = {https://fiqhemoqaran.mazaheb.ac.ir/article_105986_ea739778e5132daabb187d78f389baf1.pdf} }
