In Imami Jurisprudence, it has been referred to under titles such as Contract of Condition (Bay‘ al-Shart) and Optional Contract (Bay‘ al-Khiyar). Bay‘ al-Wafa’ differs from Bay‘ al-Shart in terms of jurisprudential background and some decrees. However, there are many similarities between them, because both are created on the necessity and are known as a sale contract and both have the property effects. There are also many controversies about the nature of this kind of contract and its effects in Sunni Jurisprudence. Following the Imami Jurisprudence, Bay‘ al-Shart has been included in the Iranian Civil Code, in articles 458-462, but changes have been made to its effects and the decrees related to it over time. On the other hand, the legislator in Afghanistan, following the Hanafi Jurisprudence, has included Bay‘ al-Wafa’ in Civil Code of this country. This paper attempts to study this legal subject in different Muslim schools of thought, determining the basis of legislation and the economic usage, and then it tries to analyze its nature, effects and decrees related to it, and express the evolutions which have been made in law in this regard.}, keywords = {Contract of Trustworthiness (Bay‘ al-Wafa’),Contract of Condition (Bay‘ al-Shart),The Period of Option,Contract Including the Right to Refund,Deficient of Corrupt Contract (‘Aqd al-Fasid)}, title_fa = {مطالعه تطبیقی بیع وفا در فقه مذاهب اسلامی و حقوق ایران و افغانستان}, abstract_fa = {بیع وفا که «بیع جایز»، «بیع امانت» و «بیع عهده» هم نامیده شده، نهادی است که در اواخر قرن پنجم هجری در فقه اهل‌سنت شهرت یافته است و در خصوص ماهیت و احکام آن اختلاف‌­نظرهای شدیدی وجود دارد. در فقه امامیه از آن تحت عنوان «بیع شرط»، «بیع خیاری» یا «بیع الخیار» سخن به میان آمده است. بیع وفا از نظر پیشینه فقهی و برخی احکام، با بیع شرط تفاوت دارد؛ از جمله می‌توان به لزوم توقیت خیار به یک‌ زمان معین در بیع شرط، در فقه امامیه و ممنوعیت توقیت خیار در بیع وفا، در فقه اهل­‌سنت اشاره نمود. اما از آن‌ جهت که هر دو، بر مبنای ضرورتها به وجود آمده­‌اند، از نظر ماهیت (عقد بیع و دارای اثر تملیکی‌)، با هم شباهتهای فراوانی دارند. اما در خصوص ماهیت این عقد وآثار آن در فقه اهل­‌سنت اختلاف­‌نظرهای زیادی وجود دارد؛ قانون مدنی ایران به تبع فقه امامیه بیع شرط را در مواد 462-458 ذکر کرده، اما به مرور تحولاتی در احکام آن ایجاد شده است. قانونگذار افغانستان نیز به تبع فقه حنفی بیع وفا را در قانون مدنی آن کشور ذکر کرده است. در این مقاله تلاش شده با مطالعه تطبیقی نهاد حقوقی یادشده در فقه اسلامی (مذاهب مختلف)، ضمن تعیین مبنای تشریع و کاربرد اقتصادی آن، ماهیت و احکام و آثار آن‌ را بررسی و تحولاتی که در حقوق موضوعه در این خصوص صورت گرفته است را بیان کنیم.}, keywords_fa = {یع وفا,بیع شرط,مدت خیار,معامله با حق استرداد,عقد فاسد}, url = {https://fiqhemoqaran.mazaheb.ac.ir/article_105973.html}, eprint = {https://fiqhemoqaran.mazaheb.ac.ir/article_105973_bdf088476ca1b8813105356fb8bcb610.pdf} }
